Justification for the choice of the negotiated procedure without prior call for competition

Extreme urgency brought about by events unforeseeable by the contracting authority and in accordance with the strict conditions stated in the Directive: Yes
Other justification for the award of the contract without prior publication of the contract notice in the OJEU
In order to benefit from the reduced time-limit referred to above, in addition to the box(es) to be ticked above, please explain in a clear and comprehensive manner why the award of the contract without prior publication of a contract notice in the Official Journal of the European Union is lawful, by stating in any case the relevant facts and, as appropriate, the conclusions of law in accordance with the Articles in Directive 2004/18/EC (500 words maximum):
The contracting authority is a provider of social housing and the contract is for lift maintenance and repair services in the context of the property management provided by the Contracting Authority. The contract has been procured without advertising because of extreme urgency which was unforeseeable by, and not attributable to, the Contracting Authority, namely the insolvency of the Contracting Authority's incumbent provider of lift maintenance services Independent Limited. the insolvency of this company meant that the Contracting Authority was unable to provide lift maintenance services to the housing stock for which it is responsible. The urgency of ensuring continuity of lift maintenance services meant that the Contracting Authority was unable to comply with the time limits specified in regulation 16 of the Public Contracts Regulations 2006 as amended.
