3. Explanation

Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union is
lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive: (500 words maximum)
Only one bidder expressed interest in bidding for this lot as part of a wider competitive process following the restricted procedure. The results of this competition were considered internally, and, following further benchmarking and a legal advice it is considered legitimate to award a contract without prior publication of a notice. In effect if was concluded that there is no interest from the market to participate, as bidders would not have been able to meet specifically the pricing conditions of the Contracting Authority which were to offer adjustments to the Nat Fed Rates version 5.1. - being only reductions. Normally in this area of work scaffolding companies work with large contractors. In this requirement it was expected a scaffolding company to work as and when needed with the internal reports service without a guaranteed minimal turnover. This condition of work had not been received well by the market.
